Former federal judge Luttig warns Jan. 6 committee

Retired federal Judge J. Michael Luttig, a strong conservative revered by many Republicans, will appear before the House's Jan. 6 committee on Thursday. "America's democracy was threatened."

Luttig will likely say the RNC is incorrect to call portions of Jan. 6, 2021's events "legitimate political speech" and caution other conservatives not to dismiss the severity.

Two persons acquainted with the retired judge's scheduled testimony verified them to CBS News.

He'll also explain how he persuaded then-Vice President Mike Pence to ignore Trump's efforts to prevent Biden's election certification.

A source familiar with Luttig's scheduled testimony said he views it as a serious and solemn occasion equivalent to a Supreme Court hearing.

Pence's attorneys and advisers sought Luttig's advice and conservative stamp of approval before congressional certification. Luttig temporarily advised the vice president's staff.
